"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face human smuggling charges, he was held in immigration custody.

In her decision, the judge pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."
