The Failure of the 28-Point Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Falter

Europe experienced widespread relief on Monday, as the diplomatic emergency sparked by the announcement of a new comprehensive peace framework for resolving the conflict appeared – temporarily – to have been stabilised. A Washington representative spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, the Kremlin made its response: a renewed assault of rocket attacks on Kyiv.

The Cycle of Diplomacy and Destruction

The sequence of opposing developments captured the harsh reality of the outgoing year. By day, negotiation efforts are waged: hopeful statements are released from various governments. Immense energy is devoted on managing particular approaches. By night, Russian leadership brutally reminds the world that, for them, military action persists as the key method for achieving "resolution".

Nighttime Reality

As Russia's attack unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is capable of detecting rocket firings from enemy soil, a capability provided through up-to-date information. From vantage locations, defense planes that had been scrambled to engage hostile cruise missiles streaked across the sky – advanced fighter aircraft provided to Ukraine by Western partners.

Moments later, Kyiv's air-defence systems activated: multiple launches fired to intercept a incoming threat. This was a modern interception technology at work, probably supplied through allied countries. Every deployment creates sudden vibrations, rattling buildings. The moment of terror quickly gives way to grim resignation: possibly the incoming missile won't cause damage this time, sparing the city from catastrophe and another blackout.

Ongoing Risks

Soon after, a large-caliber weapon fired at a unmanned aircraft in the vicinity, part of a rapid response unit – probably Western-made equipment. Regrettably, the projectiles didn't strike the enemy aircraft – it continued its flight toward its destination.

Intermittently, this continued until dawn. Kyiv greeted the morning news: multiple fatalities, damage and infrastructure problems in multiple buildings as a result of the nocturnal offensive. As always, everyone still maintained normal activities – experiencing conflict. But those 24 hours encapsulated Ukraine's vital need on Western support – a dependence that European nations are clearly incapable to substitute in the short term.

Failed Diplomacy

The detailed framework from American leadership generated strong feelings, debate and serious worry – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after previous diplomatic encounters and international summits.

Every new approach from US leadership follows the same pattern: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This trend will, certainly, continue.

Strategic Calculations

It is easy to blame specific actors of persistently promoting Moscow's conditions. But that does not seem to be the whole story. US administration operates on a principle understood by experienced diplomats: you cannot achieve through diplomacy what you have been unable to protect through force. The American government presumes that it is impossible to compel Moscow to surrender the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, Washington does minimal to deter Moscow, through words or deeds, from assuming that the situation will not evolve additionally in its favour in the coming year.

Divergent Views

Therefore, the Kremlin is confident that the clock favors them – that Ukraine and its partners are nearing depletion. Their incentive to sign a deal that does not give them the largest achievable advantage is virtually nonexistent. There may be numerous efforts to end hostilities, but they will carry on as long as Russia's leadership remains supremely confident in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, slowly losing lives and land but averting a total frontline collapse until situations evolve in its advantage.

Present Conditions

Factually, there are no actual prerequisites for a truce. Now, individual motivations are becoming relevant: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to alienate a key ally, and on the other, to mobilize citizens around the flag against any initiative Kyiv finds unworkable, so that their focus does not switch to homefront challenges. And although their objective will now be significantly challenging after current events, it remains highly unlikely that this will alter their fundamental strategy.

These conflicting dynamics are guiding negotiations.

Assessment and Future

It took a only one week to eliminate the suggested clauses of the latest plan. Aggressive and erratic handling of the matter by Washington, pushback by Ukraine and the rest of Europe, along with calming attempts of negotiators, and finally, recent disclosures, all achieved their purpose.

While new plans based on established approaches are approaching, Kyiv, London and other European capitals should draw one fundamental conclusion: Ukraine and Europe will only be able to resist political attacks from Washington that are rooted in Kremlin requirements and show specific hesitation to change the course of events, if they stand together and enhance their military capacity at a much faster pace. If they do, neither external pressure nor military threats will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, primarily depend on sustained allied backing.
